All charges have been dropped against five teens in Brooklyn, New York who were accused of gang raping an 18-year old girl they witnessed having s*x with her own father in a playground. The district attorney handling the case says inconsistencies in the girl’s story and her unwillingness to cooperate with investigators led to the decision. According to the New York Post, District Attorney Ken Thompson released a statement saying, “That night, this young woman’s father and the five young men engaged in conduct that was reprehensible and wrong, but because of the lack of reliable evidence, criminal charges simply cannot be sustained. She also refuses to cooperate with any prosecution against her father, who was engaging in s*xual conduct with her.
The teens accused of raping the girl, Denzel Murray, Ethan Phillip, Onandi Brown, Shaquell Cooper and Travis Beckford, said when they arrived at the park, the teen girl was having s*x with her father who was under the influence of alcohol. One of the teens captured recorded the video on his cell phone of the girl with her pants down and she is seen sitting on the ground with a smile on her face rocking back and forth. One of the teens asks the older man in the video, “Can we have some of that?” Later on in the video you can hear one of the teens saying, “You said, ‘Yeah.’ That’s what I’m saying, it’s lit OK, like you know what I mean? I could tell you a freak.”
The father and daughter initially told investigators they were at the park when five teens approached them. They said one of the teens had a gun and all five of them took turns s*xually assaulting the girl. The father claimed while this was happening, he ran off to get help at a deli nearby but he was turned away because he was so drunk, he couldn’t be understood. When the father finally found police, he took them back to the park, but the teens had fled the scene.
DA Thompson said the teen girl recanted her story of the s*xual assault and the presence of a gun. She also had no injuries that were consistent with being raped, but DNA from two of the teen boys were found by a rape kit. All the charges including rape, criminal s*x acts, and s*xual abuse were dismissed with prejudice.
Denzel Murray’s lawyer released a statement from his client saying, “It is an overwhelming feeling to be facing these charges, and it is an overwhelming feeling to be exonerated of them. Onandi Brown’s attorney also released a statement on behalf of his client saying, “Onandi and his family are thrilled and relieved by the news. He’s going to do his best to try and put this incident behind him.”
