On Tuesday the defense lawyer for Philip Williams, 36, said her client was being harassed by Victoria Goreaciuc when he threw the pυnch.
During opening statements, defense attorney Rachel Black said Williams may have called Goreaciuc a “piece of crap” after she refused to tip him for taking a picture, but that gave her no right to throw ice at his head.
“Saying you’re a piece crap is a really obnoxious thing to do and unfortunately in New York we have to deal with stuff like that. It’s actually not a crime to be a jerk, unfortunately or fortunately,” said Black, according to the New York Daily News.
According to Black, Goreaciuc was the “the initial aggressor in a confrontation with a confused and bewildered Mr. Williams, who had been struck in the back of a head with not a snowball but an ice block.”
Black says her client was only protecting himself against the aggressor, Mrs. Goreaciuc.
“He turned and acted in self-defense because he reasonably believed that Ms. Goreaciuc was going to use physical force against him because she had just used physical force against him,” Black explained.
The incident was escalated when Goreaciuc’s husband got in on the action, stealing her client’s property. Eventually a person dressed as Batman convinced the man to give Williams his property back.
“Admittedly this is not Ms. Goreaciuc’s proudest moment … but [WILLIAMS’]response was to pnch Ms. Goreaciuc’s on the side of her face,” said Assistant District Attorney Andrew Stengel.
