Sherry Peel Jackson is a former IRS agent and certified public accountant who has publicly spoken out about the fact that there is no law that actually requires American citizens to file an income tax return and that there also is no law that makes anyone liable for paying the federal income tax.
Jackson was named as a plaintiff in the “We the People” Foundation case which used the First Amendment to petition the government for a redress of grievances, stating that the government should have a duty to respond to taxpayers’ demands for an explanation about federal income taxes. The argument was rejected by the United States Court of Appeals for the District of Columbia Circuit on May 8, 2007. The Foundation’s appeal to the United States Supreme Court was also rejected on January 7, 2008.
In October 2007, Jackson was indicted on four counts of willful failure to file tax returns.
She made the following statement to the jury: “You have heard the truth of how the Internal Revenue Service, Department of Justice, Federal Reserve and politicians have perpetuated this smoke and mirrors – dog and pony show on you the American people for over 88 years. You have heard of American families devastated by the invasion of privacy and unbridled fear placed upon them through threats of liens, levy’s and even jail time. In my tenure as an IRS agent, I personally saw marriages broken, families torn apart, homes confiscated and businesses destroyed – all while my colleagues and I were out making unjust demands on the American people – without the proper authority. Now you be the judge.”
A jury took less than 30 minutes to convict her despite the fact that there is no law mandating the payment of income tax. She was sentenced to serve four years in federal prison, serving five months of that time in solitary confinement. She was released on August 8, 2011.
Jackson authored three books while in jail, and she has since founded to ministries and begun a consulting business. She is considered a hero by many for being willing to stand up to the IRS and federal government.
