U.S. Airman, Michael Giles, Seeking Commute In 25 Year Sentence

In a repeat of the constant chatter that has been the repeal of mandatory minimum sentences, there is a member of our military that is in peril.

Michael Giles who was a member of the United States AirForce, and served a tour in Iraq and Kuwait was sentenced to a mandatory minimum of 25 years in prison.

Giles who was involved in a shooting in Tallahassee, Florida where a fight broke out at a night club, was forced to discharge his weapon into his assailant. The melee which according to Change.org occurred when the victim became upset because someone interrupted his dance. When this happened the victim allegedly stated that the next person he saw, he was going to hurt.

That person happened to be Michael Giles. Giles claimed he was attacked by the victim and knocked off his feet. Upon trying to regain his footing, he drew, discharged and struck the victim in the leg.

Giles was charged with aggravated battery with a deadly weapon causing bodily harm and sentenced to a mandatory minimum of 25 years in prison. Giles attempted to use the stand your ground law, applicable in Florida however it was denied.

If you remember this is the same, stand your ground law that George Zimmerman used in his defense of the Trayvon Martin killing.

Giles who had no previous criminal offenses, no violent offenses, was not offered a plea deal, and not given probation even at the behest of the police officer that handled the case. Upon her understanding and analysis of Giles she deemed he would be a suitable person for probation.

Because of the witness statements, recommendations from the officers and Michael’s military service, his parents have penned a letter to the Governor to have his sentence commuted. His parents are asking for the clemency board to waive the stipulation for one half of the sentence to be served prior to consideration for parole. This is an ongoing case and more will be coming forth.
