Boston Celtics Jared Sullinger Avoids Prosecution as Girlfriend Refuses to Testify

Boston Celtics‘ Jared Sullinger had domestic charges filed against him by his girlfriend Deann Smith dropped after she refused to testify invoking her Fifth Amendment right to avoid self-incrimination.

Sullinger was arrested after allegedly pinning Smith to the bed and throwing Smith to the floor of the townhouse on August 31.  It was also reported that he smashed her cellphone to that she could not call police.

The Boston Globe reports that Sullinger’s attorney, Charles Rankin, requested that the charges be dropped due to the lack of evidence.

“Moreover, discovery in the case has revealed there are not excited utterances nor any other admissible evidence to support the charges,” Rankin wrote.

When a victim refuses to testify against their alleged abusers in a domestic violence case, prosecutors can cite what the victim tells first responders as “excited utterances”.

Back in September, Sullinger pleaded not guilty to assault and battery, destruction of property and witness intimidation.  The witness has maintained that she wanted the charges dropped but prosecution pushed to convict Sullinger anyway.

When asked about how he felt about the verdict, Sullinger responded, “Ready to play.” Sullinger, recovering from back surgery, said his arrest was “humbling and embarrassing” in a statement released by the Boston Celtics.

“I know that this situation has brought both sorrow and embarrassment to my girlfriend, my family, the Boston Celtics organization, my teammates, and my fans,” he said. “To all of you, I apologize from the bottom of my heart.”

Jared Sullinger was drafted to the Boston Celtics with the 21st overall pick in the 2012 NBA Draft.  The power forward from Ohio State University announced that he would miss the rest of the season on February 1, 2013 with a back injury and has been working to make a comeback.

Hopefully, the 21-year-old can bounce back and learn from this situation.

  1. A verdict is the result of a bench trial or a jury trial. Since there was no trial the end result was not a verdict.
    In ths case, the matter was dismissed because of witness non-cooperation. Whoever covers legal cases should know the difference.
