Judge in Usher vs.Tameka Custody Case Steps Down

usher-tameka-raymondFulton County Superior Court Judge Bensonetta Tipton Lane, who was widely criticized for her handling of Usher’s custody case, has recused herself from the case.

Lane’s decision to grant custody to Usher Raymond raised eyebrows, and brought into question Lane’s connection to Usher’s attorney, John Mayoue.

Lane’s recusal comes after Tameka Raymond’s attorney, Lisa West,  filed a motion to preserve information on computers used by Lane’s late sister for her re-election to the bench.

In a statement, West said,  “these records were in the possession of Judge Lane’s sister who passed away in March 2012 and are now in the possession of her sister’s estate. Judge Lane and her sister’s children are at odds over who will be the administrator over her sister’s estate.”

According to West, the computer also contains,  “valuable information highly relevant” to Judge Lane’s recusal.

Numerous blogs have reported that Usher’s attorney helped Judge Lane get reelected and that his firm contributed to her reelection campaign.

West has always argued that Judge Lane should recuse herself because of the connection she has to Usher Raymond’s attorney.

CBS Atlanta reports:

In October, West argued unsuccessfully that Lane should recuse herself from the Raymond case because Lane didn’t disclose that Mayoue was allegedly on Lane’s re-election committee and had helped her garner nearly 83 percent of the funds in Lane’s campaign coffers leading up to the election. Lane denied the motion for recusal in October but apparently changed her mind two months later. 

This may suggest that Tameka Raymond has another chance of regaining custody of the couple’s sons. Only time will tell if that’s true, but this is definitely a win for Tameka Raymond.
